Can I make a whiplash injury claim for a water sports accident?

During the summer months we receive a variety of holiday accident claims including slips and trips in hotels, car accidents abroad and product liability claims for faulty sun and heat protection products but we have also received whiplash injury claims from those who have been hurt whilst doing water sports.

When you jet off to sunnier climes and the hot sun starts beating down you are bound to head for the nearest stretch of water and jump into the blue but this can end up in you sustaining serious personal injury.

Deep-sea-diving can result in tourists who are keen to explore the depths of the ocean suffering the bends, otherwise known as Decompression Sickness (DCS). The bends is usually suffered when an individual is exposed to a reduction in the pressure surrounding their body, which can cause gas bubbles to form most commonly in their shoulders, elbows, knees and ankles. This can lead to a variety of symptoms, including deep localized pain, headaches, dizziness, visual disturbances and memory loss.

The bends is most likely to occur if a diver ascends rapidly from a dive or fails to carry out decompression stops after a long or deep dive. Unfortunately, it is unusual for divers to make successful compensation claims for such conditions as it is an occupational hazard and something that is expected if special care is not taken.

Even if you avoid jelly fish, sting rays and sharks when you dive off the nearest pier you could still sustain a whiplash injury when you hit the water and your body is jolted by the impact. But, again, unless the careless act of another person caused you to sustain injury it is unlikely that you will be able to claim for whiplash injury compensation.

On the other hand, if you paid to have a go at jet skiing through your tour operator and as a result of not receiving adequate instruction you sustained a neck injury, you may be able to make a whiplash injury claim. Similarly, if you suffered personal injury while attached to a boat while water skiing or parasailing that went too quickly and the driver was found guilty of putting you in unnecessary danger, then you may have grounds to claim for personal injury compensation.
