Successful whiplash injury compensation claim cases

At The Claim Solicitors, we have dealt with a wealth of compensation claims made by people who sustained whiplash injuries through no fault of their own. Read a whiplash injury overview.

A whiplash injury can cause many physiological symptoms such as chronic neck pain, stiffness and headaches. It can also lead to psychological problems such as depression. This means that those who sustain a whiplash injury are likely to take time off work and may experience a significant loss of earnings which they need to claim back.

Our personal injury solicitors have helped many to recover lost earnings and gain compensation for pain and suffering caused by their personal injury. By offering free legal advice, talking through each stage of the claim and working closely with each customer they have seen many successes.

We offer a no win, no fee service. This means that our clients donít pay a penny in up front costs. Whatís more, if you lose your case, you wonít pay anything at all. No win, no fee, is exactly what it sounds like. Read more about no win no fee claims.

There are many situations where you may sustain a whiplash injury such as car accidents and sporting accidents. We will share with you some of those successful cases we have dealt with in order to provide you with some insight into the claims process.

Rear-end car accident

In June 2004 a 29-year-old civil servant was travelling southbound along the M4 when a 4x4 driver from the outside lane pulled into the middle lane behind him. The 4x4 was travelling fairly close to our customer when the traffic began to slow to a crawl of about 10mph. At this point, the driver who was tailgating our customer smashed into the rear of his car.

This sudden impact was pronounced by the bull bars at the front of the 4x4 and was more than enough to initiate the whiplash motion. Our customer's head was thrown forwards and backwards at speed, wrenching the ligaments and muscles in his neck.

He took down the registration plate, insurance details and contact details of the 4x4 driver while they waited for the police to arrive. The police arranged for our customer's car to be towed away and gave him a lift home as he was pretty shaken but not showing any signs of personal injury.

Our customer did not experience any discomfort until he awoke the next morning with severe neck and back pain, a headache and dizziness. Read more about signs and symptoms of whiplash injury.

The 29-year-old called his doctor and told him of the car accident the previous day. The doctor advised him that it was likely he was suffering a whiplash injury and that he required further tests. Following these, it was confirmed that our customer was suffering a whiplash injury and he was signed off work for two weeks.

A friend advised the man to get in contact with The Claim Solicitors, the personal injury claim specialists. We assessed the eligibility of his claim and agreed to accept the claim on a no win no fee basis, and reassured him that we would fight to get him the most compensation available for his whiplash injury. The case was successful and our customer was awarded £2,750 for the injury and £850 in special damages.
