What is a no win no fee agreement?
Legal aid for over the vast majority of personal injury claims was abolished in 2000, leaving those that wished to pursue compensation claims with little option but to find an alternative avenue of support down which to turn. This is where the rise of no win no fee claims began. Read more about the fall of legal aid and the rise of no win no fee.
Making a personal injury compensation claim can be stressful, both emotionally and financially, but all of our solicitors work under a no win no fee arrangement.
How no win no fee works
Originally referred to as a conditional fee arrangement, no win no fee essentially means that your personal injury solicitor will take on your case on the basis that if you are unsuccessful they will not receive their fee. Read about common misconceptions of no win no fee.
The Conditional Fee Agreement Regulations came into force on 1st April 2000, the same day that Pt II of the Access to Justice Act 1999 was brought in. The latter permits the solicitor to recover their success fee and the cost of their client's after-the-event insurance premium from their opponent's insurance company.
However, there are more costs to consider than your solicitor's fees and you need to be aware that, under the no win no fee agreement, if your case is unsuccessful you may be eligible to pay:
- Your opponent's legal costs
- Both yours and your opponent's disbursements. These are other expenses such as medical reports.
- But, most personal injury solicitors will arrange for you to take out an insurance policy which covers such costs before your case commences. This is known as after-the-event insurance.
