No win no fee and work-related deaths protocol
A protocol relating to work-related accidents and fatalities has been agreed between the Health and Safety Executive (HSE), the Association of Chief Police Officers (ACPO) and the Crown Prosecution Service (CPS) setting out liaison rules (2006).
The protocol states that police will conduct an investigation if there is an indication that manslaughter or some other criminal offence has occurred in an accident at work. No win no fee claims are made on a daily basis in the UK for work-related accidents.
The HSE will conduct an investigation relating to offences and pass information relating to criminal offences to the police. The prosecution process is co-ordinated by the CPS and the Health and Safety Executive (HSE).
The police must consult the CPS about corporate manslaughter no win no fee claims cases and if the CPS decides to prosecute, they in turn must keep the HSE advised of case progress.
If prosecution occurs, the HSE will disclose copies of documents given to the coroner, but not to anybody else without their permission.
If both the CPS and the HSE prosecute, discussions will take place relating to management of the case and joint proceedings will then ensue. Decisions will then be taken as to who will take lead responsibility for the prosecution.
