No win no fee success story for Leeds man

The roads are a dangerous enough place without having to worry about the few irresponsible drivers who choose to get behind the wheel under the influence of drugs and alcohol.

Not only are motorists at risk from being involved in a car crash, but many pedestrians will also become victims of road accidents and suffer serious personal injuries as a result of someone else's careless driving.

With the Government highlighting the benefits of walking, many people have ditched their car in a bid to lead a healthier and more energetic lifestyle. Therefore, it is unfortunate that people who are eager to benefit their health as well as the environment should have their safety jeopardised when walking near any traffic.

Matthew's story
One such person to be injured in a serious road traffic accident was 37-year-old Matthew. The chartered accountant from Leeds contacted us to make a no win no fee claim after he had been hit by a car whilst using a pelican crossing.

Before the accident occurred, Matthew had fallen into the same routine that many of us find ourselves in. He spent the majority of his time in his car rushing from one place to another and had taken to eating overly processed food during a busy day at the office.

In 2004, he was diagnosed as being clinically obese and warned by his doctor that he could risk suffering a fatal heart attack if he didn't change his lifestyle in the near future.

With this shocking wake-up call, Matthew decided to make a major change to his standard of living. He abandoned his Ford Mondeo and took up using public transport, which required making a 20 minute walk to his nearest train station every morning and on the return journey home.

But just two months into his healthy new routine, Matthew was involved in a serious road accident which led him to make a no win no fee claim for personal injury compensation.

On the day of the accident, Matthew had been working late at the office and caught the 8.35pm train home from Leeds city centre. As he walked the final leg of his journey, Matthew pushed the button of a pelican crossing and waited for the green man to appear.

The crossing made a bleeping sound and indicated that it was safe to cross the road. Matthew heard the noise and took a step off the pavement but just as his foot touched the ground, a Ford Escort crashed into him, hitting him with the full force of the bonnet and sending him several metres down the road.

Matthew was taken to hospital where he received treatment for a serious head injury, broken ribs and a punctured lung. The Doctors were concerned that he may have suffered a brain injury in the car accident but this was later ruled out following a scan. He spent two weeks in hospital and was forced to take a further two months off work whilst he recovered from his personal injuries.

Matthew later discovered that the driver of the Escort had been under the influence of alcohol on the day of the crash and decided to make a no win no fee compensation claim.

After searching the internet for personal injury websites, Mathew contacted YouClaim where he received clear and friendly advice on how to proceed with making a no win no fee claim. We were happy to take on Mathew's case and reassured him that he would receive a dedicated no win, no fee service.

A member from our panel of personal injury solicitors contacted the driver's insurance company, who admitted full liability for their client's negligence during the road accident. They immediately made an offer of 13,700, which Matthew's personal injury solicitor suggested he reject because he felt that Matthew deserved a higher amount of compensation.

The insurance company re-evaluated the sum of compensation to avoid the expensive costs of taking the case through the courts and agreed to pay almost 18,000 to Matthew for his serious injuries, loss of earnings and expenses for medical treatment.

He was delighted with the outcome of the case and said, "I'm really pleased I decided to make a no win no fee claim after the accident. I was seriously injured in the crash and missed out on two months at work. The compensation will help me a lot financially."
