Woman refused compensation for accident claim
A woman, who suffered a serious back injury when an 80ft boat mast came crashing down on her, has lost her battle to win compensation for her accident claim.
Zoe Jay, 30, from Cheddar, Somerset, was holidaying in the Caribbean five years ago when the boating accident happened.
She was struck on the back by an 80ft catamaran mast, which had snapped in bad weather conditions, and suffered serious personal injuries.
Ms Jay needed 12 hours of surgery following the holiday accident and claimed that she has been left in constant pain since sustaining the injuries.
Alleging that she can no longer work and requires full-time help to look after her children; Ms Jay contacted a personal injury lawyer and made an accident claim against the travel operator, Thomson.
But a judge at the High Court ruled that Thomson was not responsible for the accident and said that a fault with the manufacturing had caused the mast to break.
Ms Jay was disappointed with the outcome of her accident claim and says that she has been severely affected by the incident.
She added, "I thought I was going to die and I was in complete shock and unbearable pain."
