Neck injury claim win for assistant

Whiplash compensation has been awarded to a teaching assistant who suffered the neck injury as a result of trying to shield students from a collapsing wall frame.

The 49-year-old was working at a Church of England school in Worcestershire when the frame came down from the wall.

In addition to a component of whiplash compensation, the woman was awarded sums for head and shoulder injuries and consequent sleeplessness and anxiety.

The claimant commented, "The accident has changed my life. I had six young children pulling out the equipment with me, who would have died if it had fallen on them."

The company responsible for mounting the wall frame paid out the whiplash compensation. They later issued a statement: "We are deeply regretful of the incident and any distress caused.

"As a company we take health and safety seriously and have since revised some of our procedures."
