Teacher faces costs in lost personal injury compensation claim
A Scottish woman involved in a personal injury compensation claim has lost her case, five years after receiving the injury in an Inverness nightclub.
The Sheriff offered sympathy for the victim of what he described as "clearly a most unpleasant and unfortunate accident."
"However," he added, "as she is by no means the first to discover, misfortune and sympathy are not in themselves a sufficient basis in law for successful litigation."
She now faces a potential bill for thousands of pounds in costs for the failed compensation claim. Neither she nor her personal injury solicitor could be reached for comment yesterday.
The accident injury occurred when a door in the night club was opened on the woman's hand, causing a broken thumb and much pain. The teacher told the court that her life had been affected by the injury, leaving her with reduced strength and intermittent pain.
The owner of the nightclub told the local press that he was happy with the result of the personal injury compensation claim, saying, "It shows that it is worth companies standing up to these 'no win, no fee' firms."
