Personal injury solicitor celebrates 'common sense'.

A no win no fee personal injury solicitor in New South Wales, Australia has hailed a work accident compensation claim ruling there as 'a triumph for common sense.'

His client claimed for pain and loss of earnings resulting from personal injuries after falling five metres from a ladder while installing guttering on a house in the western suburbs of Sydney. The court heard that his employer had left the 32-year-old man alone just prior to the work accident to make a telephone call.

The personal injury solicitor said that the man's employer should have been there to ensure the ladder's safety catch was engaged, and to supervise 'an extremely tricky job'.

In summing up, the judge said, "It is clear to me that this work accident could have been avoided. He [the claimant] was only new to the job, and if proper safety precautions had been taken, he would never have had to endure months of pain and suffering as a result of this work injury.'

He added that his employers should consider themselves lucky that his spinal injury had been only relatively minor and not led to any form of permanent disability.

After the ruling, the man's no win no fee personal injury solicitor said his client was 'delighted that the ordeal is finally over'. He also said that the British man was, "just looking forward to returning to his birthplace of Newcastle, England and sitting down to a roast with his parents."

The compensation claim payout was awarded at $21,381 (Australian).
