Compensation put on hold by confusion
A Hampshire woman who has over 24 years experience working for the Ministry of Defence is still in the dark over who she should claim compensation from more than four years after suffering a debilitating shoulder injury in a trip and fall accident. Unfortunately, until it can be established just who was responsible for maintaining the footpath on which she tripped, her personal injury solicitor is unable to commence her claim.
The would-be claimant tripped over raised paving while out walking with her mother in 2003. As a result of the trip and fall accident she sustained a shoulder injury, which eventually needed operating on. She now suffers persistent pain in the affected area.
While speaking to her local Hampshire newspaper, the MoD worker commented on the frustration endured by her and her personal injury solicitor, "We must have spent a week full time trying to get to the bottom of who was responsible, it's disgraceful."
She also called for the appointment of a town council and town clerk who would be able to quickly establish who has ownership and responsibility for the town's roads and footpaths, meaning that trip and fall compensation claims like hers would be able to be resolved more quickly.
None of the UK's personal injury solicitors are likely to be contacted with claims for accidents resulting from the same bit of footpath anytime soon as the paved area was asphalted within weeks of the accident.
