"Loss of society" caused by brother's death
A ten-year-old boy from Scotland has instructed personal injury lawyers to commence a compensation claim for "loss of society" following the death of his brother in a tragic level-crossing train accident.
The boy has succeeded in getting legal aid personal injury lawyers to represent his compensation claim, in which he hopes to secure damages for the loss of company his sibling would have provided him with had he not been killed.
The accident happened when the 18-year-old agricultural worker transgressed a partial barrier onto the tracks and was hit by a train that threw him 60ft from the point of impact.
Although the family of the deceased man have decided to proceed with the litigation, neither they nor their legal team are yet sure exactly how much compensation they hope to obtain.
However, the boy's father did comment, "If they [Network Rail] came to me and said they were sorry, paid the cost of the funeral and put full double barriers on level crossings, then I would be happy."
One of the personal injury lawyers representing the case commented, "This was a devastating incident with tragic consequences. We are in the process of advancing a claim via the courts."
