Passenger injury claim writ served at High Court

Personal injury lawyers representing a Wiltshire man have submitted a compensation claim writ to the High Court after he suffered severe multiple injuries in a July 2005 road accident, during which he was passenger in his own car.

The claimant's personal injury lawyer, together with the legal team representing the defendant, have already reached agreement regarding the issue of liability. It is now up to the court to make a decision on how much compensation to award. The claimant and his lawyer are understood to be seeking more than £300,000 for his injuries, which included a head injury, and a fractured and dislocated neck. He is also claiming for loss of earnings, as well as associated medical, care and accommodation costs.

In the High Court compensation claim writ it is alleged that the defendant was negligent in driving carelessly and having consumed excessive alcohol when she mounted a roundabout and subsequently collided with a brick wall, injuring the vehicle owner, who was a front seat passenger at the time of the accident.

Personal injury lawyers representing the claimant have also asked for special dispensation to return to court in order to claim further damages in the event that the man's condition deteriorates. This is because there is a statistically significant risk that he might go on to develop a spinal cyst.
