Injured biker receives damages boost

A Sussex man who was seriously injured in a motorcycle accident has had his bid for personal injury compensation boosted following an Appeal Court decision.

The 45-year-old Hove resident initially had his compensation claim thrown out of the local county court after it was ruled that he was at fault for the road traffic accident, but an Appeal Court judge has now given him leave to challenge that decision.

The personal injury compensation claim is the result of a head-on collision that occurred between the motorcyclist and a fire engine in August 2004. The biker suffered extensive injuries in the smash including ten broken bones and nerve damage.

The judge presiding over the original county court hearing ruled that the man had jumped a red light and so the driver of the fire engine could not be held responsible for causing the road accident.

The appeal judge agreed with the biker's argument that this could not be proved and so decided that another personal injury compensation hearing should be held in the near future.
