Rider fails in crash claim appeal bid
A man from Sheffield has failed in his attempt to secure motorbike injury compensation for a traffic accident in which he sustained spinal injuries and damaged ribs.
The case, which was heard by the Appeal Court, concerned a June 2007 accident in which the rider had braked suddenly to avoid colliding with a heavy goods lorry pulling out of a driveway.
A no-win no-fee solicitor representing the claimant had sought to ascribe liability to the haulage company's insurer, arguing that a lookout should have been in place to spot his client.
However, no motorbike injury compensation was awarded on the basis that the claimant had "misread" the situation and braked with unnecessary force, causing him to lose control of his motorcycle.
The Appeal Court decision means that the rider has now lost his last hope of securing a settlement of motorbike injury compensation.
