Baby's window injuries see claim

A London accident claim is being made by the mother of a boy who suffered life-changing injuries when he was hit by falling window outside a hostel in the centre of the city.

The London accident claim writ submitted by no win, no fee solicitors representing the claimant alleges negligence on the part of the hostel for its failure to secure the 5ft high window by the chain attached to its bottom corner, its failure to maintain the premises and its failure to fix the window following previous problems.

As a result of the falling window, the boy, who was four-months-old at the time, suffered a fractured skull and a brain haemorrhage. The child was hospitalised and seven months after the accident needed a further operation to reduce swelling.

He is now four-years-old and has impaired cognitive skills and serious growth problems. He is also incontinent, suffers epileptic seizures and has only a single-word vocabulary. His mental age is unlikely to improve.

Two years ago the hostel admitted health and safety breaches during a Health and Safety Executive prosecution; this may have a positive bearing on the family's London accident claim.

The family are seeking a settlement in excess of £300,000.
