Man escapes needing to make no win no fee claim

A man who slept through a 35ft tree crashing into his home was lucky to escape suffering serious personal injuries.

Oscar Henrique could have needed to make a no win no fee claim for injury compensation after a large beech tree fell through his house in Exeter, Devon.

Fortunately, the tree missed hitting Mr Henrique when it crashed through the wall at 3am but caused severe damage to his spare room.

Mr Henrique said, "I did hear a noise but I thought it may be an earth tremor so I went back to sleep.

"The next thing I knew the police were ringing me and I saw a giant tree on my house. I couldn't believe it.

It is believed that Mr Henrique will have to pay thousands of pounds to repair the damage caused to his house.

If he had suffered serious personal injuries in the near fatal accident, he could have considered making a no win no fee claim for injury compensation.

He added, "I've been asking the council to sort that tree out for 24 years."
