Parents make compensation claim for son's birth injuries
The parents of a man born with cerebral palsy after doctors failed to carry out a caesarean section have welcomed the news that he will be awarded £2.2 million in personal injury compensation.
Susan and Tony Nicholas contacted personal injury solicitors and made a medical negligence claim against Nether Edge Hospital, Sheffield, after their son suffered brain injuries during his birth in June 1979.
Doctors discovered that Nicholas, now aged 27, was breached and had to be delivered using forceps. He was starved of oxygen and as a result was left suffering permanent brain damage.
The family's personal injury solicitor argued that Nicholas' brain damage could have been prevented if an emergency caesarean had been carried out two hours before.
The birth injury compensation claim was made against the hospital's managers, Sheffield Health Authority, and Nicholas was awarded a total of £2.2 million for the medical negligence he endured.
