Personal injury payout for London woman
A London woman has received a 100 percent compensation ruling for a bus accident that left her with serious personal injury to her left leg and ankle.
Initially, the woman was awarded £12,000 for her bus accident injuries but later had this amount reduced by one-third on the grounds of contributory negligence, with a judge ruling that the claimant was standing too near the bus and should have been more alert.
However, the claimant's personal injury solicitor took the case to the Appeal Court, arguing that the woman was in no way responsible for the 2005 incident, which occurred near a bus stop in Crystal Palace, South East London.
The judge ruled, "She was standing on the pavement area designated for pedestrians, still several inches back from the edge of the road. Had the bus driver got the angle right, there would not have been a problem. The driver got the angle wrong."
The bus company was ordered to pay the woman an £18,000 bus accident compensation settlement, plus legal costs.
