Injuries to the head, chest and other parts of the body are also common and we can help you to claim for personal injuries sustained in a car accident that wasn't your fault just like we helped the man described below.
Dangerous dozing driver causes crash
In June 2006 we received a call from a man who wanted to make a car accident injury claim after being involved in a crash caused by a driver-driver.
The 34-year-old, who works away on oil rigs in the North Sea, told us how he had been driving home after two weeks away from his family when the car accident occurred. He was making his way to his hometown of Whitely Bay, Tyne and Wear, during the early hours of the morning.
When he set out for the journey home, the rig-worker did not feel tired as he was used to working long hours. However, he promised himself that as soon as he started feeling dozy he would pull over at a service station and have a coffee and some fresh air. This was valuable advice that the driver of a car coming in the opposite direction should have taken, in fact he should never have ventured behind the wheel at all.
Our client told us how he remembered seeing a BMW 3 Series come hurtling out of the opposite lane, swerving awkwardly and travelling at great speed straight towards him. The rig-worker told us that the driver of the other vehicle did not appear to be awake. His head was down and seemed to be lulling around and it later turned out that he had fallen asleep while driving after having far too much to drink the night before.
He tried to swerve out of the BMW driver's path and swerved towards a ditch but the BMW still ploughed into his car's rear-side. Immediately after the car crash occurred, the rig-worker started experiencing pains shooting through his shoulders and into his neck which a paramedic attributed to whiplash.
The man was also experiencing a headache but it was unclear whether the pain was a result of his whiplash injury or a minor head injury which he sustained when he hit his head on the windscreen during the collision. The rig-worker was taken to hospital and received treatment for superficial facial burn injuries as well as whiplash and he was also kept in for observation overnight.
He was required to take three weeks unpaid time off work to recuperate and when he began feeling better he decided that he would pursue a car accident injury claim for the earnings that he had lost and the pain and inconvenience his personal injuries had caused.
We appointed him a leading personal injury solicitor who specialises in car accident compensation claims and the case proved successful. The drink-driver was prosecuted by the police and our client was awarded just under £5,000.
