Accountant in grape gripe claim
A 55-year-old accountant who alleges that a dropped grape on the premises of a Marks & Spencer store caused him to slip and suffer a ruptured quadriceps tendon is seeking to claim more than £300,000 in personal injury compensation from the store.
He believes that the chances of his personal injury compensation claim are supported by his claims that he found a small piece of squashed grape on his right sandal following the slip and fall accident. He also refuted counter-claims that the fruit may have been attached the sole of his sandal before the accident, adamantly maintaining that had it already been there his cleaner would have found it and removed it while performing her weekly clean of his footwear. He told the court, "I have a cleaner who cleans all my shoes on a Wednesday or Thursday, and if there was anything beneath the sole she would have taken it off."
The accountant says that he is claiming compensation for the loss of earnings he has allegedly sustained as a result of the accident. He argues that this is a result of the "loss of confidence" and depression he suffered in the wake of the slip and fall accident, leading to him failing to recruit enough clients willing to be pay his £225 an hour fees.
M&S are denying liability for the personal injury compensation claim.
