A recent work accident claim
The Claimant – male, aged 32 instructed The Claim Solicitors in connection with a work accident that occurred on 24th August 2001 .

The Claimant was employed by the Defendant as a delivery driver. On the day of the accident he was required to make a delivery of beverages to a public house owned by the Defendant. In the course of making the delivery he went to open the flaps at the top of the cellar and as he lifted the left hand flap into the vertical position the flap came loose in his hand. The flap was heavy and he tried to hold on to it in an attempt to prevent it falling down into the cellar and injuring the person below. In the process he felt acute pain in his left shoulder and as a result sustained injury.

The Claimant suffered a partial tear of the superior part of the rota cuff but without any separation. He was off work for 4 weeks and underwent physiotherapy.

A letter of claim was sent to the Defendant on 1st October 2002 and liability for the work accident was admitted in full by the Defendant on 7th February 2003 .

The Claimant underwent an operation to repair his injury on 23rd January 2004 .

Due to expiry of the limitation period proceedings were issued on 10th August 2004 and negotiations ensued with the Claimant eventually accepting the sum of £7,600 in February 2005, in full and final settlement of his work accident compensation claim.
