Making a compensation claim
What you can expect from us
Choose The Claim Solicitors and we will guide you through the simple process of making a compensation claim for your injury or accident. This process is simplified below:
Step 1 Once your first correspondence is received by a member of our claim team we will be able to provide you with any advice you need and offer information about The Claim Solicitors and the service we provide. We will also assess the circumstances of your injury and advise the likelihood of having a successful compensation claim.
Step 2 If we believe you have a valid compensation claim and you want to pursue a personal injury claim, your details will be passed to one of our claims collators. They are responsible for obtaining all the information (e.g. medical reports, witness statements etc) we need to put your personal injury compensation claim together as quickly as possible. The claim collator will also inform the other person’s insurance company that you intend to pursue a compensation claim against them for damages caused by their client’s negligence.
Step 3 Once all the information needed has been collected, a ‘claim negotiator’ will compile the details of all the financial losses that are being claimed for into a ‘Schedule of Losses’. These may include pain and suffering, loss of earnings and the cost of medication. This schedule will be sent to the other person’s insurance company, with a request for the compensation claim to be settled for the specified amount.
Step 4 The majority of personal injury compensation claims are settled out of court within a short period of time. However, unnecessary it may be to issue Court procedures and, if no agreement can be achieved it may be necessary to pursue your compensation claim to trial. If this happens it is usually because there is a dispute on liability or a high compensation payment.
