What needs to be proven to make a successful personal injury claim?
Under UK legislation, for a personal injury claim to be successful, it must be proven that:
- The person you believe is at fault had a duty of care for you
- The person you believe is at fault did not take reasonable precautions to prevent a breach of that duty of care (negligence)
- The person you believe is at fault caused personal injury to you as a result of their negligence
- You felt pain and suffering as a result of the injury
