Making a personal injury claim after a non fault accident

Personal injury compensation can be claimed if you have been injured in an accident caused by another person. Generally speaking, you have three years from the date of the accident in which to make a claim, although there are a couple of exceptions to this rule, which we will explain below.

A claim can be made against a person, an employer, a company, or other body.

If you have suffered a personal injury in any type of accident that you believe was someone else’s fault, call us now on 0800 197 32 32 for expert legal advice about pursuing a compensation claim.

We will work for you on a no win, no fee basis, which means you can make a claim entirely risk free. This is because no win, no fee is exactly as it sounds; if your claim is unsuccessful, you do not have to pay a fee.

Exceptions to the thee year time limit

The Limitation Act 1980 outlines that, in most instances of personal injury, a claim must be made within three years of the date of the accident. However, there are exceptions to this rule.

- Child injuries; if you or your dependant was injured whilst they were younger than 18, then the child has until their 21st birthday in which to make a claim.

- Asbestos-related diseases; if you or a loved one has contracted an asbestos-related disease, it is the date of the knowledge of the disease that dictates the start of the three year limit. The situation varies depending on the particular disease, and an experienced solicitor, such as the experts on our team, will be able to provide you with more information.

- Foreign road traffic accidents; although you may be entitled to make a claim for an accident you have suffered in another country, the rules vary from country to country. If you are injured in these circumstances, then it is best to speak to an expert lawyer as soon as possible.
