Exceptions to the thee year time limit
The Limitation Act 1980 outlines that, in most instances of personal injury, a claim must be made within three years of the date of the accident. However, there are exceptions to this rule.
- Child injuries; if you or your dependant was injured whilst they were younger than 18, then the child has until their 21st birthday in which to make a claim.
- Asbestos-related diseases; if you or a loved one has contracted an asbestos-related disease, it is the date of the knowledge of the disease that dictates the start of the three year limit.
