Woman makes personal injury claim against
dead boyfriend

A woman from West Sussex is seeking personal injury compensation from her dead boyfriends' estate after he caused a horrific car accident in which he was killed outright and also claimed the life of his mother. The woman, Miss Zarin, aged 24, sustained head and chest injuries, broken bones, a punctured lung and has lost some mobility in her left arm. Her family says that she has not been the same since the accident and is making the personal injury claim to secure her future.

Miss Zarin was in the back seat of her boyfriends' Citroen Saxo when he collided with a lorry on the A3 at Hindhead. After the accident she had to spend five weeks in intensive care, followed by two weeks in a neurological ward. Miss Zarin had to learn how to walk again and had to be taught how to take care of herself, something that she would have taken for granted before the road traffic accident.

Making a personal injury claim against someone who is deceased is extremely rare but in this case it is felt by the Zarin family that the only way to help their daughter move on with her life is to seek compensation.

The Zarins family issued a writ for "negligence for personal injury and other losses" to the Queen's Bench Division of the High Court against "the estate of Dominic Stuart West deceased" on April 21.
