School accident leads to personal injury claim
A teenager who was not allowed to go to hospital after breaking his wrist in a school accident has won thousands of pounds following a successful personal injury claim.
Ty McNamara, now 15, sued the Ridings School in Ovenden, Halifax, after tripping over a rope and colliding with a wall during a PE lesson three years ago. In severe pain, he reported to the school nurse but was told he had just bruised himself and was given an ice-pack.
The sobbing 12-year-old was told to sit and wait in the reception area for six hours before finally being allowed to telephone his mother. His worried mum, Ivy, took him to hospital immediately and doctors diagnosed him with a broken wrist.
She said, "He was in agony and the school weren't even sympathetic. It was disgusting."
The personal injury claim eventually ended in an out-of-court settlement and the exact amount of injury compensation has not been revealed.
Ty has revealed he plans to spend some of the money on a new computer and will save the rest until he is 18.
Speaking to the press, he said, "I am happy it is all over. I feel annoyed it has taken so long.
"It has been on my mind all this time. Now it is over I can start looking forward to the rest of my life and hope it never happens again."
The school refused to comment following the personal injury claim settlement.
