Insurance worker makes personal injury claim
An insurance worker has made a successful personal injury
claim after she tripped and hurt herself falling over a pile of accident
claim forms.
Linda Riley, an underwriter for Norwich Union, reached an out-of-court settlement following her attempt to make a compensation claim for £5,000 damages against her firm’s parent
company, Aviva.
Miss Riley, who lives in Newburgh, Fife, insisted that the company was to blame for her tripping over the claim forms which
had been left in files on the floor. Her personal injuries
caused much discomfort and resulted in a substantial amount of time taken off work.
Her writ stated, “It was its [Aviva’s] duty to provide her with a safe system of work. It was its duty to
ensure there was a safe access and egress within the work premises.
“It was reasonable that if items such as files were left on a traffic route they would present a danger to persons
such as Miss Riley. They ought to have known or anticipated an accident would be likely to occur. In each and all of their
duties Aviva failed.”
The level of compensation that Linda Riley actually received as a result of her personal injury claim has not been revealed.
