A recent accident in the work place claim
The claimant, who is male and aged 41 at the date of the accident in August 2003, was employed at a bakery and was putting foils on baking trays ready to make pies. As the claimant bent down to pick up a tray he suddenly felt a sharp pain to his right hand. The claimant was not wearing gloves and the trays were cold. When the claimant looked at his hand he saw a ½ centimetre round of flesh had been gouged out of his hand approximately 1 centimetre below his little finger on his right palm.
As the company’s first aider was unable to stem the bleeding the claimant attended a nearby hospital where he was bandaged and was signed off work by his GP. Unfortunately the wound did not heal properly and the claimant had a lump of scar tissue which had become quite pronounced.
The claimant contacted The Claim Solicitors and a no win, no fee agreement was entered into in February 2004 together with Legal Expenses Insurance.
A Letter of Claim was sent to the bakery (the defendant) in February 2004. Liability was admitted by the defendant in August 2004.
An expert consultant orthopaedic surgeon was instructed to prepare a report, as evidence to support the claim.
A Part 36 Offer was put forward by the claimant in May 2005 in the sum of £1,280. Negotiations ensued and subsequently the agreement was reached without the issue of proceedings in May 2005 whereby the claimant accepted the sum of £1,280 in full and final settlement of his accident in the workplace compensation claim.
