Accident at work compensation claim

A recent accident a work compensation claim
The claimant who is male and aged 39 at the date of the accident was employed as a bakery operative.

On the day of the accident the claimant was at work in the tray room which entailed putting trays into stacks onto a conveyer belt to be distributed to other parts of the factory. The trays that the claimant was given to work with had been stored in the chiller room and as they had been waiting to go onto the conveyer belt, they had started to get wet and slippery.

The claimant put the stack of trays onto the conveyer belt and then as he put another lot on, they slipped back off pushing the claimant against the wall and causing him to lose balance. His leg twisted under a metal railing and the claimant felt pain in his left knee.

Following the injury the claimant attended a near by hospital where x-rays were taken and a plaster cast was applied to his leg. He remained off work for two weeks following the accident.

The claimant contact The Claim Solicitors and entered into a no win, no fee agreement with an ‘After The Event’ legal expenses insurance which we took out on the claimant’s behalf, to protect him from legal fees, if his personal injury claim was unsuccessful.

A Letter of Claim was sent to the the bakery owner (the defendant) on 26 th November 2004 and liability was admitted by the defendant in February 2005.

A consultant orthopaedic surgeon was instructed to prepare a medical report, to support the accident at work compensation claim. Negotiations ensued and subsequently agreement was reached without issuing court proceedings in June 2005.

The claimant accepted the sum of £2,500 in full and final settlement of his accident at work compensation claim in June 2005.
