A recent accident at work claim
The Claimant, male, aged 45, injured in an accident at work on 5th January 2000 when he slipped on oily liquid on the floor whilst pushing a trolley. The Claimant injured his back and received anti-inflammatory medication and physiotherapy treatment.

A letter of Claim was sent to the Defendant on 3rd March 2000 and liability was admitted. A Part 36 offer was made by the Defendant on 8th February 2002 in the sum of £3,250.

Medical evidence was gathered and as an agreement could not be reached proceedings were issued on 19 th December 2002 .

The Defendant made a payment into court on 16th January 2004 in the sum of £1,000 and made a further payment on 7th June 2004 to bring the total sum in court up to £2,500. The Claimant did not accept the offer. A trial took place on 3 rd May 2005 and the Claimant was awarded £19,195.26, in full and final settlement of his accident at work claim. The Defendant was ordered to pay the Claimant’s costs with penal interest and indemnity costs being awarded from 20th October 2004.
